PDP, Ogbulafor, Shuluwa Suffer Set Back, As Court Dismisses Appeal

IT was a bad day on Friday evening for both the People’s Democratic Party (PDP) national headquarters, its immediate past chairman, Prince Vincent Ogbulafor and the chairman of the Caretaker Committee of the party, Chief Abu King Shuluwa, when the appeal they filed against the judgement of a Plateau State High Court, which restrained the caretaker committee set up by the PDP National Working Committee (NWC) was dismissed by the Court of Appeal sitting in Jos.

When the NWC dissolved the Executive Committee of the party in the state, the then state chairman of the party, Prof. Dakum Shown, went to the State High Court to seek redress, saying his fundamental rights had been infringed just as he claimed that he was not given a fair hearing before the purported dissolution.

The State High Court, presided over by Justice Mohammed Sirajo, after full court proceedings, held that his court had the jurisdiction to entertain the matter.

Not satisfied with the judgment, the PDP, Ogbulafor and Shuluwa appealed the judgment, saying the court lacked jurisdiction to entertain the matter and that it cannot unnecessarily interfere in the internal affairs of the party, as a member does not have the right to take the party to court to ventilate his grievances.

Delivering the judgment yesterday, the Court of Appeal, presided over by Justice Monica Dongban Memsem, dismissed the three appeals as lacking in merit.
